ASX Shareholders Seek to File Lawsuits Against Former Directors

According to CoinMeta, shareholder Rosherville Pty Ltd has notified the Australian Securities Exchange of its plan to seek permission from the Federal Court to hold certain former officials and directors accountable for their roles in the failed chessboard alternative project. ASX disclosed the proposed legal derivative action on August 12, less than six weeks after the exchange was fined A$20.5 million for the same project. ASX emphasized that the proposed lawsuit is not directed against the company itself, and no details about the identities of the former officials, the specific allegations, or the remedies Rosherville intends to pursue have been revealed. Rosherville stated that the lawsuit will be filed under sections 236 and 237 of the Australian Companies Act; such legal derivative actions allow qualified shareholders or officials to initiate litigation on behalf of the company, but court permission is required. The court must confirm that the applicant is acting in good faith, that granting permission is in the best interests of the company, and that there are serious issues pending resolution.
