According to CoinMeta, Coinbase Chief Policy Officer Faryar Shirzad stated that Coinbase has responded to the joint request for comments on the definitions and compliance frameworks for perpetual contract products by CFTC and SEC, and proposed three recommendations: establishing a flexible compliance framework to promote customer choice, classifying equity perpetual derivatives as securities related to exchange-listed securities that are permitted to be regulated by any regulatory agency under securities and futures regulations, and allowing such contracts to be traded on exchanges regulated by these agencies. Coinbase noted that perpetual derivatives and predictive markets provide investors with new investment and risk management tools, but the complex jurisdictional boundaries between the two regulatory agencies impose inconsistent requirements on economically related products, hindering market participants' ability to offer and integrate products through a single, U.S.-regulated technology stack.
