OCC Revising Bank Regulation and Enforcement Rules

According to CoinMeta, the Comptroller of the Currency (OCC) revised its bank supervision and enforcement framework on August 27, instructing inspectors to focus on significant financial risks and substantive violations rather than minor procedural defects. The OCC issued two updated policy manuals and, together with the Federal Deposit Insurance Corporation, released a final rule that classifies bank law violations into two categories: "substantive" and "technical." The revised enforcement manual establishes three principles: escalation, tailored responses, and limited corrective actions. The OCC stated that enforcement responses should be proportionate and predictable, and inspectors must consider financial risks, legal violations, as well as the size and complexity of the institutions when deciding whether to take formal action. This revision applies to all nationally regulated banks, federal savings associations, and federal branches under the OCC's jurisdiction, including regulated trust banks that engage in digital asset custody, stablecoin reserve management, or blockchain settlement.
