New Jersey files a lawsuit against Kalshi with the Supreme Court

According to CoinMeta, on September 2nd, New Jersey applied to the United States Supreme Court for a review of the ruling regarding Kalshi, requesting confirmation as to whether the Commodity Exchange Act prevents states from applying gambling laws to sports contracts traded on exchanges regulated by CFTC. New Jersey Attorney General Jennifer Davonport and Mary Joe Flaherty, the acting director of New Jersey’s Gaming Enforcement Division, submitted a petition challenging the ruling of the Third Circuit Court. The ruling in this case contrasts with similar cases in Nevada and may provide an opportunity for the Supreme Court to resolve the growing disputes over federal versus state jurisdiction. New Jersey believes that similar lawsuits have been filed in at least 20 states, and different rulings have led to regulatory uncertainty.
