Four Major U.S. Institutions: The Crypto Market Structure is Being Built in the Absence of Laws
2026-10-12 16:52:30
According to CoinMeta, as reported by Forkast, the structure of the US crypto market is being established in the absence of laws. After the Digital Assets Market Clarification Act failed in the Senate on September 15th, the legislative path was blocked, but regulatory mechanisms are still in operation. The Treasury Department, the Federal Reserve, SEC, and CFTC are moving towards an effective date of January 18, 2027. The regulatory framework recently introduced by CFTC provides a federal registration pathway for exchanges that handle leveraged, margin, or financing retail transactions. Under the Congressional Review Act ( CRA ), rules completed before the summer of 2028 will become irreversible, and regulatory agencies are racing to finalize the framework within this time window. Despite obvious gaps in the CFTC framework, especially since the spot market is still governed by state laws, various agencies are still making efforts to advance.
