South Korean National Assembly: Digital Assets Act may set a cap on the shareholding ratio of major shareholders in virtual asset exchanges

According to CoinMeta, and as reported by Yonhap News, the Legislative Investigation Office of the South Korean National Assembly analyzed that if Naver Financial incorporates the Upbit operator Dunamu into its subsidiary system and further meets the conditions for a holding company in the future, it may face conflicts between two sets of regulatory rules. Under South Korea's Fair Trade Act, a holding company is generally required to hold at least 50% of the shares in unlisted subsidiaries and at least 30% in listed subsidiaries. However, the Digital Assets Basic Act currently under discussion by the National Assembly may set limits on the shareholding percentage of major shareholders in virtual asset exchanges. The former sets a "lower limit" for shareholding, while the latter may set an "upper limit." If both apply simultaneously, companies may need to adjust their governance structures.
