This exemption applies to companies outside the EU serving customers. Some regulators have requested information from Binance, and if dissatisfied, they may take enforcement actions, including fines. According to the rules of the crypto asset market, unlicensed companies should immediately take measures to stop their operations within the EU, only assisting existing customers with transferring or selling their holdings.
