The administrative consent order finally issued by FTC on August 27, 2026, indicates that although they were actively regulating AI marketing practices, no framework for regulating the autonomous AI agency behaviors had yet been established. FTC accused these companies of misleading small business customers by claiming to use AI and algorithms to listen to consumers' conversations through smartphones, smart TVs, and other devices for local advertising targeting. Investigations revealed that this technology did not utilize voice data at all; instead, it resold standard email addresses and marketing lists. This action is part of FTC's broader "AI compliance" initiative, which is based on Section 5 of the FTC legislation that prohibits unfair or deceptive practices in commerce. Since these companies lied about the existence of their technology, FTC had a clear path for law enforcement. The total settlement amount was $930,000, and a 20-year compliance supervision was imposed, demonstrating the agency's desire to prevent companies from using the "AI" label as a guise for traditional data practices in marketing.
