CFTC News: CME Opposes the Rejection of the Litigation Against Perpetual Contracts in Cryptocurrency

According to CoinMeta, CME opposes the Commodity Futures Trading Commission’s (CFTC) rejection of its lawsuit regarding perpetual futures of cryptocurrencies in the United States. CME submitted a response on October 2nd in a federal court in Washington. The dispute involves the CFTC’s approval of Kalshi’s Bitcoin perpetual futures contracts in May. Hyperliquid’s CEO, Jake Chervinsky, criticized CME’s latest document, stating that the exchange failed to adequately address arguments regarding its competitive position and the scope of interests under the Commodity Exchange Act. CFTC proposed to reject CME’s lawsuit on September 2nd, arguing that CME lacked a Third Amendment basis as it failed to prove specific competitive harm caused by the regulatory agency’s decision. CFTC described the lawsuit as “insignificant.” The agency also noted that CME itself can still seek approval for similar crypto perpetual futures. CFTC believes that any harm caused by CME’s non-listed perpetual contracts is partly self-inflicted. CME raised objections to the agency’s position in its opposition on October 2nd. The court has not yet made a ruling on the rejection request.
