The report indicates that the issue of vacant seats for CFTC has become a point of contention in the negotiations of Clarity Act. Clarity Act is a bill concerning the structure of the crypto market, and for the Senate to advance its passage, it needs to gain the support of Democratic senators.

Some Democrats have criticized that the White House has been slow to fill the seats reserved for Democrats at SEC, as well as the 4 cross-party vacant seats at CFTC, which has weakened the proper functioning of regulatory agencies and also affected the atmosphere of bill negotiations.

A person familiar with the review process and a Republican involved in advancing the bill said that if the White House explicitly commits to filling the vacancy of CFTC, it could become a concession to help the bill pass. However, this is not the only obstacle facing the bill; ethical issues surrounding the interests of the Trump family's crypto business are also slowing down the legislative process.

A key procedural vote will take place on September 15th.

Craig stated again this week that the Trump administration should ensure that CFTC has the personnel and resources necessary to fulfill its regulatory responsibilities.

Thompson also stated that he has not received any feedback from the White House regarding potential nominations at this time, but he believes that qualified candidates should be submitted to the Senate for confirmation as soon as possible.
