The U.S. Securities and Exchange Commission's inspection department announced the priorities for the 2027 fiscal year, for the first time explicitly listing "super intelligence and other advanced technologies" as key areas for review, and incorporating tokenization into the list of market infrastructure risks. This document covers over 34,000 registered institutions, which means brokers, investment advisors, and transfer agents will face increased scrutiny regarding AI tools and tokenized products.

  • The U.S. Securities and Exchange Commission (SEC) Inspection Department announced the inspection priorities for the fiscal year 2027, for the first time explicitly listing "super intelligence and other advanced technologies" as areas that require enhanced scrutiny.
  • Tokenization has also been listed, categorized under the risks of the evolving market infrastructure, alongside the reform of U.S. Treasury bond clearing. This means that brokerage traders, investment advisors, and transfer agents should expect that inspectors will pay attention to tokenized products.
  • These key points cover more than 34,000 registered institutions supervised by this department.

The Division of Inspections of the U.S. Securities and Exchange Commission announced its inspection priorities for the fiscal year 2027 on Thursday. In this list, which contains eight items, SEC has included "super intelligence and other advanced technologies that may affect market operations, compliance, fraud prevention, and investor protection" within its official inspection framework.

In a broader technical classification, AI is categorized as an "emerging technology," which also indicates that the department intends to examine how AI tools affect the compliance initiatives and fraud detection efforts of various registration agencies.

This represents a change in the scope of review. In previous versions, AI was mainly regarded as a business tool being used by investment advisors; however, the description in 2027 positions it as a systematic market variable.

Tokenization is separately listed in the market infrastructure section. This department identifies 'risks related to the evolving market infrastructure, including reforms in U.S. Treasury bond clearing, tokenization, and related developments' as key areas of focus.

For those securities firms, investment advisors, and transfer agents that began to expand their tokenization product lines during the period of relaxed regulation represented by Atkins, this means that their compliance efforts will now attract the attention of inspectors, not just at the policy level.

The head of this department, Keith Cassidy, described this as an adaptive regulatory approach. In a statement released on SEC, he stated: "Our method enables us to adapt to the constantly changing market environment, identify emerging risk patterns, respond to new threats, and anticipate areas where investors and the market may be vulnerable."

The inspection department also made it clear that this list is not exhaustive; inspectors still retain the discretion to examine any issues related to compliance with federal securities laws within the scope of the entire registered institution.

The focus of the 2026 fiscal year inspection was announced in November 2025, and what stood out was that for the first time since 2021, the crypto industry was no longer listed as a separate area of concern. At that time, this was seen as a signal that under the leadership of Paul Atkins, SEC was shifting away from the law enforcement approach of the Gary Gensler era.

The documents from 2027 did not restore this separate chapter, but they did include AI risks and tokenization in the list, covering the two major technological trends that have had the greatest impact on capital market activities over the past year.

Currently, the inspection programs of this department cover over 34,000 registered institutions, including investment advisors, investment companies, brokerage traders, clearing houses, and transfer agents.
